Seven year old child told his teacher that he saw boobies on the internet. This child was being raised by this Father for three years beacuse Mother had 5 different kids by 5 different men, one of whom raped literally her oldest daughter. The CYF caseworker interviewed the child at school and without further investigation removed the child from Fathers custody and placed this child back with Mother in her chaotic household with no bed, no school and no medical care. At the time of the hearing Attorney for Father cross examined the caseworker and it was in fact revealed that the boobie picture was of a woman with her arm across her chest and no further investigation was done.
The child was sleeping on the floor at Mothers and she had not taken him to school. The CYF casework did not take the laptop from father or request the pictures the child had seen. Counsel for Father took the laptop and looked at all the pictures to prove there was in fact no "pornography" and that Father was clearly not a danger to his son. In fact father had seen to it that the child had perfect attendance at school, all up to date immunizations and dental records and was thriving in his care. The casework said in court she "forgot to get the records".
The attorney for CYF, the attorney for Mother and the attorney for child, after they all had lunch together tried to go up against and bash Father and his Counsel. Their ego's fortunately did not ruile the day - the Judge did.
The Judge ruled that there was insufficient evidence to continue the removal of the child and order the child be returned to his father. The Child cried and ran to his Father in joy and they hunged all the way out of the courthouse.
Lesson on this story is dont let CYF in your house without your lawyer present. Hire an attorney who is not afaird to take on the corruptions of the CYF system and argue for what is best for Father and child. You never know you just might find justice in the most horrible of places
